1. Agreement to Terms

By creating an account, accessing, or using SmokeTag ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy (together, the "Agreement"). The Service is operated by Rowant Labs LLC ("Company," "we," "us," or "our"). If you do not agree, do not use the Service.

2. Definitions

  • "Subscriber" means the individual or legal entity that registers for an account and pays for the Service.
  • "Alert" means an SMS notification sent by the Service containing information about a potential fire incident.
  • "Metro Area" means a geographic coverage area within which the Service monitors fire dispatch communications.
  • "Incident Data" means address, incident type, severity, and related information extracted from public radio communications.

3. Service Description

SmokeTag is a subscription-based alert service that monitors publicly available fire dispatch radio communications and sends SMS notifications about potential fire incidents in your selected metropolitan area. The Service uses automated AI-powered transcription and extraction to identify incident details from publicly broadcast radio communications.

4. Important Disclaimers — No Guarantee of Coverage or Accuracy

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. YOU ACKNOWLEDGE AND AGREE TO ALL OF THE FOLLOWING:

  • No guarantee of complete coverage. The Service does not and cannot capture every fire dispatch call, incident, or emergency in any metro area. Coverage depends on the availability, reliability, and quality of publicly accessible radio feeds, which vary significantly by location and are outside our control.
  • Metro areas have different levels of coverage. Some metro areas have extensive fire dispatch radio coverage with high-quality automated dispatch systems. Others have limited or intermittent coverage. We make no representation that any metro area will provide a specific level of coverage, call volume, or incident detection rate.
  • AI transcription and extraction is imperfect. Incident information — including addresses, incident types, severity levels, and unit details — is extracted from radio audio using automated AI systems. These systems may produce inaccurate, incomplete, garbled, or incorrect results. Radio transmissions may be unclear, overlapping, or partially received.
  • Addresses may be wrong. Extracted addresses are best-effort interpretations of radio audio. They may be misspelled, partially captured, or entirely incorrect. Always independently verify incident locations before taking any action.
  • Confidence levels are estimates only. High, Medium, and Low confidence indicators are algorithmic estimates and do not guarantee the accuracy or reliability of any individual alert.
  • Alerts may be delayed or missed entirely. SMS delivery depends on carrier networks, third-party services, and system availability. Alerts are not guaranteed to be delivered in real time or at all.
  • The Service may experience downtime. We may need to perform maintenance, updates, or modifications that result in service interruptions. Third-party systems (radio feeds, transcription services, SMS carriers) may experience outages outside our control.
  • No guaranteed business outcomes. We make no representation or warranty that the Service will result in any particular business outcome, lead generation, revenue, or competitive advantage.
  • Not a substitute for professional judgment. The Service is an informational tool only. It is not a substitute for your own due diligence, professional judgment, or independent verification of incident details.

5. Acceptable Use and Compliance

SmokeTag provides publicly available information to help restoration professionals respond to fire incidents in their communities. You are solely responsible for how you use this information and for ensuring your actions comply with all applicable laws.

By using the Service, you agree to:

  • Use the information in compliance with all applicable local, state, and federal laws, including any laws governing solicitation, licensing, consumer protection, and contact with affected persons.
  • Not use the Service for any purpose that violates any applicable law or regulation.
  • Accept full responsibility and liability for any and all actions you take based on information received through the Service, including but not limited to any outreach, solicitation, or business activity directed at homeowners, property owners, or any other parties.
  • Acknowledge that Rowant Labs LLC provides information only and does not direct, instruct, or advise you on how to use that information. Any decisions you make based on this information are yours alone.

Rowant Labs LLC assumes no liability whatsoever for your use of information obtained through the Service. You assume all risk associated with your actions. We reserve the right to terminate your account without refund if we determine, in our sole discretion, that you are using the Service in violation of these Terms or applicable law.

6. Subscription, Billing, and No Refunds

  • Subscriptions are billed monthly ($289/month) or annually ($3,179/year) through Stripe.
  • Your subscription renews automatically unless cancelled before the renewal date.
  • You may cancel at any time through your account settings or the Stripe customer portal.
  • Upon cancellation, you retain access until the end of your current billing period.
  • All fees are non-refundable. Because the Service provides real-time informational alerts that cannot be "returned," we do not offer refunds for any reason, including but not limited to: dissatisfaction with coverage quality, low alert volume in your metro area, inaccurate alerts, service interruptions, or change of business plans. By subscribing, you acknowledge this no-refund policy.
  • We reserve the right to change pricing with 30 days' notice to existing subscribers.
  • You are responsible for applicable taxes, duties, or assessments, except taxes on our income.

7. SMS Communications (TCPA Compliance)

  • By providing your phone number and subscribing, you expressly consent to receive automated SMS messages from SmokeTag containing fire incident alerts.
  • Message frequency varies based on fire incident activity in your selected metro area. Some areas may generate significantly more or fewer alerts than others.
  • Message and data rates may apply depending on your carrier plan.
  • You may opt out at any time by replying STOP to any message. Opting out of SMS does not cancel your subscription or entitle you to a refund.
  • Reply HELP for assistance or contact support@smoketag.com.
  • We will not share your phone number with third parties for marketing purposes.

8. Data Sources and Third-Party Dependencies

SmokeTag monitors publicly available fire dispatch radio communications via third-party platforms including Broadcastify. This information is already publicly accessible. We process it using AI services (including third-party transcription and language model providers) to extract structured incident data. We do not access any private, restricted, or encrypted communications.

The Service depends on third-party systems that are outside our control. Changes to third-party APIs, radio feed availability, transcription services, SMS carrier policies, or other external dependencies may affect Service availability, accuracy, or coverage at any time without notice. We are not responsible for outages, changes, or limitations imposed by third-party providers.

9. Eligibility and Account Responsibilities

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
  • If you use the Service on behalf of a company or other entity, you represent you have authority to bind that entity.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate information including a valid phone number and email address.
  • You may not share your account or resell the Service without our written permission.
  • One subscription covers one metropolitan area. Contact us for multi-market needs.
  • You are responsible for all activity that occurs under your account.

10. Intellectual Property

The Service, its design, code, algorithms, and brand are owned by Rowant Labs LLC. Incident data extracted from public radio communications is provided for your internal business use only and may not be redistributed, resold, republished, or shared with competing services.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROWANT LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, GOODWILL, OR DATA, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM: MISSED OR DELAYED ALERTS, INACCURATE INCIDENT DATA, INCORRECT ADDRESSES, SYSTEM DOWNTIME, THIRD-PARTY SERVICE FAILURES, OR ANY RELIANCE ON INFORMATION PROVIDED BY THE SERVICE.

IN NO EVENT WILL OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. IF YOU DID NOT PAY ANY FEES IN THAT PERIOD, OUR TOTAL LIABILITY WILL NOT EXCEED $50.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rowant Labs LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service, your violation of these Terms or applicable law, your interactions with homeowners or property owners based on information received through the Service, any solicitation or business activity conducted using information from the Service, or your negligence or willful misconduct.

13. Termination and Suspension

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including but not limited to: violation of these Terms, ethical use violations, failure to pay, fraudulent activity, or if we determine continued access creates risk for the Company or others. Termination for cause does not entitle you to any refund.

You may terminate your account at any time by cancelling your subscription. Upon termination, your access to alerts and incident data will end at the conclusion of your current billing period.

14. Modifications to Service and Terms

We may modify, suspend, add, or remove metro areas, features, or any aspect of the Service at any time. Metro area availability is not guaranteed for any duration. We may update these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law provisions.

Arbitration and Class Action Waiver

YOU AND COMPANY AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL BE RESOLVED BY BINDING ARBITRATION, RATHER THAN IN COURT, EXCEPT THAT EITHER PARTY MAY BRING ELIGIBLE CLAIMS IN SMALL CLAIMS COURT. YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Arbitration will be administered by JAMS under its Streamlined Arbitration Rules. The arbitration will be conducted in English and held in Nebraska or remotely. The arbitrator's decision will be final and binding. You may opt out of arbitration by sending written notice within 30 days of first accepting these Terms to legal@smoketag.com.

16. Force Majeure

We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including acts of God, natural disasters, pandemics, internet outages, third-party service failures, radio feed outages, carrier network issues, government actions, or changes in law.

17. Severability and Entire Agreement

If any provision is found unenforceable, that provision will be limited to the minimum extent necessary, and the remaining provisions will remain in full effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Company regarding the Service.
